INTERPRETATION OF STATUTES
Question 1
1. Meaning of “adoption” and “commencement” of legislation
With specific reference to section 13(1) of the Interpretation Act 33 of
1957, the terms adoption and commencement refer to two important
stages in the legislative process.
Adoption of legislation
The adoption of legislation refers to the stage where a proposed law, in
the form of a bill, has successfully passed through all the required
legislative procedures in Parliament and has been formally approved.
During this process, the bill is debated, amended if necessary, and voted
on by the relevant legislative bodies.
In the South African legislative process, a bill must normally be
approved by the National Assembly and, where applicable, the National
Council of Provinces before it can be regarded as adopted. Once the bill
has been adopted by Parliament, it is then sent to the President of South
Africa for assent and signature. After the President signs the bill, it
becomes an Act of Parliament.
