DISCUSSION OF THE ELEMENT OF CONDUCT IN AMIR’S DELICTUAL
CLAIM AGAINST LALITA

Introduction

In South African law, delict serves as a mechanism through which a
person who has suffered harm may claim compensation from another
whose legally blameworthy conduct caused that harm. For a delictual
claim to succeed, the plaintiff must prove the existence of five essential
elements, namely conduct, wrongfulness, fault, causation, and
damage. These elements operate cumulatively, meaning that the
absence of any single element will defeat the claim.

The present problem concerns a potential delictual claim by Amir
against Lalita arising from an incident in a communal student residence
kitchen. Amir suffered a physical injury to his hand and damage to his
personal property as a result of an electrical fire caused by an
overheating kettle plug. Lalita had noticed that the plug was loose and
sparking prior to leaving the kitchen, but she failed to take steps to
remedy the danger or warn Amir, whom she saw entering the kitchen.

The question specifically requires a discussion of whether the element
of conduct is satisfied in Amir’s delictual claim against Lalita. The scope
of the discussion is therefore confined to examining whether Lalita’s
behaviour constitutes legally recognisable conduct in delict, and
whether such conduct can be attributed to her in a manner sufficient to
satisfy this first element.
