Types of partnership

• Universal and particular partnerships

Universal partnerships are not restricted to a particular transaction or a specific
business. Universal partnerships consist of two types of partnerships: the societas
universorum bonorum and the societas universorum quae ex quastu veniunt.

➢ societas universorum bonorum: property that will take place within the
context of marriage.
➢ societas universorum quae ex quastu veniunt: consists of profit within the
context of commercial undertaking.


• Ordinary and extraordinary partnerships

The liability to third parties is limited with extraordinary partnerships. There are three
types of extraordinary partnerships, namely: anonymous partnership, partnership en
commandite, and special partnerships

➢ anonymous or silent partnership: the anonymous partner is not liable to third
parties, shares the full risk of the enterprise.
