Introduction into Legal factors:
Research conducted in the last 5 years has shown that because of a lack of regulation and
awareness of the laws that need to be enforced, more than 65 percent of new companies
fail. Government has adopted 4 main laws that must be adhered to by all businesses. Such
are:


The companies Act - 1989


The Partnership Act - 1890


The Fair Trading Act - 1973


Health and Safety at work Act - 1974


Laws:


Sports law is a collection of laws applicable to athletes and to the sports they play. A number
of matters are covered by sports law. Some laws are based on the athlete 's ranking, some
laws are different according to the sport and some laws are different for other reasons. I will
define three separate laws in this section that relate to the company I have selected, Premier
Sport.


Child protection:


Safeguarding is a concept that is wider than 'child protection' and refers to the action taken
by the commission to support and protect children's wellbeing from harm. Safeguarding is an
action everyone should look at. It means working Together to Safeguard Children. Children
and young people under the age of 18 are a particularly vulnerable group and the
Commission is therefore concerned to underline the importance of ensuring appropriate
protections in place for the safety of charities. This influences a sport business in the way the
coaches would need a DBS and had a safeguard course if the business includes, for
example, coaching children. This is because when they are in their obligation, they need to
know the right and proper way to look after the children. Since premier sport is a company
that offers a coaching service,-and every single coach must have the appropriate

qualifications to ensure that they are up to date. This is to ensure that the kids in and session
are healthy and well educated.


Duty of care:


Within premier sport there are various people who have the title of duty of care. This is
because in the ranking, there are stages at which people are on different levels but have a
duty of care for those who are under them. Duty of care is a legal obligation that is used to
make sure people within a workplace are safe. Risk assessments, for instance, are set up to
be followed in order to minimise the risk of accidents and events that could occur. It is often
used in sport to ensure that individuals such as coaches keep everyone healthy, this will
have a positive impact on sports and an organisation because it makes sure that everyone is
protected and can ensure that administrators and coaches are responsible for taking care of
individuals in their care.


If you're dealing with young kids in sports , for example, you need to make sure you have
DBS tests and take a safeguard course as this will help ensure they're protected at all times.
For the people at the top of the ranks, such as administrators, there will be a duty of care to
ensure that the coaches are well treated and trained, and the coaches will have a duty of
care to provide the same treatment for the children they coach.


Riddor:


Riddor is also known as reporting accidents , illnesses and hazardous incidents. This law
means that you are expected under RIDDOR to disclose something that is protected under
the law whether you are an employer or own a premises where individuals work. If they are
work-related, it is only important to disclose such instances, only because the occurrence
occurs in the work premises, this does not mean it's work-related, the work they do
physically would lead to the accident.


Under RIDDOR, there are 4 major injuries that are considered reportable, including: death of
any person, stated injuries to employees, injuries that result in employees being disabled for
more than 7 days and injuries that result in them being taken for care directly to the hospital.
This legislation will influence premier sport because it would be important to report the
incident while coaches are coaching kids, or when coaches themselves are in training if
anything happens.
