Advising on the Possibility of Bringing a Communication Before the
Human Rights Committee (HRC)
1. INTRODUCTION
The right to life, enshrined in Article 6 of the International Covenant on
Civil and Political Rights (ICCPR), forms the cornerstone of
international human rights law. In cases where individuals are subjected
to the mandatory death penalty without judicial discretion, this right is
often compromised. The Movement Against Death Penalty (MADP), a
non-governmental organisation dedicated to the global abolition of
capital punishment, intends to file an individual communication before
the United Nations Human Rights Committee (HRC) under the First
Optional Protocol to the ICCPR. The application will be brought on
behalf of Mr Mbhekwe, a national of the Republic of Kamarara, who
was convicted of murder and sentenced to death under Kamarara’s
mandatory death penalty regime.
This legal opinion critically assesses the procedural and substantive
