BUNDEL
Naast het publiekrechtelijk orgaan bevoegd voor arbeidsbemiddeling, beginnen
particuliere ondernemingen ook arbeidsbemiddeling te voorzien. Maar Duitse
wetgeving verbiedt dit omdat publiekrechtelijk orgaan daar een monopolie op
heeft.
HvJ zegt dat een onderneming elke eenheid is die een economische activiteit
uitoefent, ongeacht haar rechtsvorm en wijze waarop zij gefinancierd wordt.
Bovendien wordt er misbruik van gemaakt van de machtspositie die het
publiekrechtelijk orgaan heeft omdat dat orgaan niet op haar eentje aan de vraag
op de markt kan voldoen.
Relevantie: basisarrest voor definitie van het kartelrechtelijk
ondernemingsbegrip, ook publiekrechtelijke instellingen kunnen ondernemingen
zijn

Definieert het begrip ‘economische activiteit’ = het aanbieden van goederen
of diensten op een bepaalde markt
3. ARREST HUMBLE & WIRTH:
Om na te gaan of onderwijs wijst op een overheidstaak dan wel een
ondernemingsactiviteit moet men naar deze arresten kijken.
Humble: onderwijs dat hoofdzakelijk door de overheid gefinancierd is, is een
overheidsactiviteit. De overheid voert dan haar sociale, culturele en
opvoedkundige taak uit. Dat er inschrijvingsgeld wordt gevraagd doet daar geen
afbreuk aan
Wirth: wanneer (kunst)onderwijs hoofdzakelijk of volledig door particuliere
middelen wordt gefinancierd en een winstoogmerk nastreeft, gaat het wel om
een onderneming met een economische activiteit.
4. ARREST ESCUELAS PIAS:
BUNDEL
Spaanse school van de katholieke kerk wil aula verbouwen. Zou daarop geen
belastingen moeten betalen (Spaanse deal tussen kerk en staat) maar die aula
gaat ook voor andere doeleinden gebruikt worden dus toch belasting betalen.
Gaat het om een eco activiteit?
HvJ: elke activiteit afzonderlijk bekijken. Voor de activiteiten die de overheid
verstrekt, het onderwijs, is het geen onderneming. Voor de activiteiten waarmee
