Introduction:
A small company asked me to for advice about an incident that took place. The incident was
about a person who was splashed with corrosive chemical which led to blindness to one eye
and burns skin. There was no one trained for first aid to help him out. They wanted a report
on any advice and want it as soon as possible.
Information gathering.
I manged to ask the member of staff that seen the corrosive splash on the person and asked
them how it took place. I visited the place and seen the danger in the workplaces and the
lack of equipment used for protection.
Consequences of management not abiding to legislation.
The legislation the company did not follow were the following:
Cosh
PPE
First aid
Management of health safety welfare.
Management of health and safety.
These following legislations were not followed leading to the incident.
The first legislation that was broken was COSH. This occurred due to the corrosive chemical
not being handled properly and the employer may have done something to control the risk
of the chemical. Therefore, splashed into someone’s eyes. The company abided to this
legislation and therefore will receive consequences. The consequences could be the
company receiving a find which could be anything from 100,000 pounds and could be fined
for each breach of COSHH. The breaches can be anything like not making a good risk
assessment, not preventing the exposure of chemicals to the employer.
Another legislation that was broken was PPE. The employer committed breaches such as not
providing safety goggles to the employees while working with the dangerous chemicals. The
company failed to something which could have decreased the risk. Firstly, the employer did
not provide googles which led to the poison going into the eye, lack of training which the
harmful chemical could of lead to a mistake and the employer did not know the corrosive
chemical was leaked until it did damage. The consequences of this could be that the
company will receive a fine of a minimum of 10,000 pounds. Furthermore, the company can
be closed due to lack of training and lack of identifying danger in the workplace.
Thirdly, the company had no first aid staff on the premises which broke the first aid act. This
meant having no first aid will mean the person injured will likely get more injured. The
breaches the company was that they didn’t train anyone first aid meaning that the health
and safety of the employers was also breached. Furthermore, the employer did not assess
