This assignment that will count for 10% of your class grade and you should draft it
and revise it MULTIPLE TIMES so it is clear and succinct. You will be graded on clarity
of expression and on understanding of course material to date. The grade will be
100, 95, 90, 85, 80, 75, 70 or F.

In four to five classes, we studied the court system, the meaning of litigation, the
litigation process, and tort law.

You work in a clothing store named “It Girl” in Queens County and a
plaintiff named Jane Doe has sued Phil Andel, your boss, as sole proprietor
of the store because Jane Doe slipped and fell on a discarded clothing
hanger in the parking lot and sustained serious injuries. Explain the four
elements of negligence that we have discussed in class to your boss,
noting that you are studying negligence in class. Also explain the three
cases discussed in chapter five of your text in the inset pages and how
specifically they relate to Jane’s lawsuit. Your boss notes that he does not
have a duty to ensure Jane Doe’s safety, that Jane assumed the risk when
she walked into and out of the store, and that her injuries are quite
severe.

Write a professional, respectful email to your boss/supervisor explaining the above
cases and how a plaintiff proves negligence (as discussed in class) in 300 words or
less (single spaced, 12 point type). Please put the case in the “Re line” of the
email, noting the court in which you think Jane will file. (would look like this: Re: Jane
Doe, plaintiff, vs. Andel, sole proprietor, It Girl, defendant, XX court in name the
place).
