The legal issue
Data Pritectin Act 1998

The Data Protecton Act 1998 provide a legal protecton for the use of people’s infor$atonn which
protect the infor$aton held about people within the business fro$ being $isused. This Act allows
businesses to control how your personal infor$aton is used by business. Many businesses store and
use infor$aton about peoplen and therefore they have to use this infor$aton in appropriately and
legally.

Tesco have to $ake sure that the custo$ers’ personal infor$aton is protected and safely secured in
their database. For exa$plen Tesco collect infor$aton for$ Club card registraton and applicaton
for$sn the infor$aton include details such as address and other personal infor$aton. They cannot
share or publish these detailsn as it have to be securely stored on a database.

Freedim if infirmatin Act 2000

The Freedo$ of Infor$aton Act beco$e efectve in 2005n it ensures to provisions for disclosed
infor$aton held by the public authority bodies. This act fves the public the right to reuuest
infor$aton held by the public authority. Moreovern this act does have so$e exe$ptons for
exa$plen if the cost of a reuuest for data surpasses an appropriate li$it n then the public authority
can decide whether there is benefts for the public interest is being served by denying the reuuest
or supplying the infor$aton .

in the database. Tesco also give their custo$ers the opportunity to write the Data protecton ofcern
legal and afairs depart$ent. Each custo$ers reuuired to pay £10 in order for the$ to aces their
infor$aton.

The Cimputer Misuse Act 1990

This act is a law that set up by the UK govern$ent to stop certain actvites using a co$putern for
exa$plen hacking into other peoples’ syste$sn $isusing the sofwaren or helping so$eone to gain
access to unauthorised portended fles on a co$puter. This act is split into three categories of
infringe$ent; unauthorised access to co$puter $aterialn unauthorised access to co$puter syste$s
with intent to co$$it another ofencen and unauthorised $odifcaton of co$puter $aterial.

This act $akes sure that the people who intent to carry out cri$inal ofence using the co$puter are
punished by the law. Tesco will $ake sure that their e$ployees use the co$puter legally and not try
carry out cri$inal ofence to $ake sure they co$ply with the law.

The ethical issue
Tesco will need to consider the code of practce that exist within the business to $aintain business
ethical. Thereforen the business ethical will include:

Email- Tesco is a large co$panyn which therefore need to send thousand e$ails to $any custo$ersn
and other stakeholders. E$ployees assu$e that their e$ails are private; howevern co$pany policies
routnely $onitor the actvites of sent e$ails. When the Tesco staf using the co$pany e$ailn they
are will represent the co$pany and any inappropriate use of the e$ailn such using inappropriate
languages will refect negatvely on Tesco. Thereforen Tesco will need to use the e$ail in suitable
way which include:

 Do use the e$ail as a $e$o for only short text
 Do use the e$ail as re$inder to deliver an i$portant $essage and urgent infor$aton such
as dates and $eetng.
 Do use the e$ail to infor$ a large group of people.

Tesco also need to consider to avoiding using e$ails for so$e satatonn which include;

 Not using the e$ails to send large docu$ents/atach$ents to people.
 Not using the e$ail to save infor$aton for long t$e storage.
 Not using the e$ail to for co$plicated uuires/ongoing dialogues or explanaton.

Internet – $any co$panies like Tesco have codes of practce on the use of the internetn which state
what their e$ployees can and cannot use the internet for. Tesco will set a guideline that their staf
need to follow in order to follow the law.

Whistle bliwing – the whistle blower is so$eonen which can raises a concern about a business
practcen usually to the $anage$ent within the co$pany or to an outside the co$pany such the
pres. The $ajor concerns are usually related to fraudn cri$e or any other serious risks that could
afect the custo$ersn e$ployeesn shareholders and other stakeholders. Tesco will provide so$eone
who is confdental and anony$ous and deals with the concern regarding to fraudn cri$e and other
serious risks actvites.

Organisatinal pilicies – Tesco will have $any policies to $ake sure that their business practses in
with regard to infor$aton that can be done ethically. This $ay involves the $anage$ent of
infor$aton in order to ensure that their business practces such $arketng are fair and just.

Infirmatin iwnership – any infor$aton created by an individual then the owner of the
infor$aton will be individual as the individual will be responsible on this infor$aton as well as
protectng the infor$aton. . In businessn the ownership of infor$aton regarded by Tesco has highly
i$portant.
