Merit

This report will now assess if all the legislations are being met by the college or not and what
will the consequences be if the laws wasn't met by the college.

Health and Safety at Work Regulations 1999

The college is meeting this law as it carries out risk assessment every 12 months unless
hazards are identified as dangerous. In the risk assessments all the possible risks and
dangers have been identified. If the college did not follow this law then the college would be
unaware as to how serious each hazard and risk is within the college. They would have no
idea as to how high the risk level is and if the risk level was to be high then students and
staff within the college would be at risk of getting seriously injured. Students in the classroom
could end up breaking their leg and being on crutches which would then seriously affect the
college’s reputation. And if they didn't cover all the possible risks then they could end up
putting someone in danger.

Also If the college does not assess the dangers within their business then they could end up
getting in trouble with the health and safety inspectors which can enforce action on the
college and give them a certain amount of days to sort out the problem (improvement
notice). The college would then have to do their risk assessments all over again and they
would be under pressure as the inspectors would be coming back to the building to see the
changes made, if the changes were not to be good enough then they could close the college
down completely and fine them.

Health and Safety at Work Act 1974

The college meet this law as they have a logbook where all visors and general public have to
sign in and out. The members of staff assist visitors and the visitors also get given a visitor
badge in case an emergency arises, the college can make sure everyone is out of the
building safety. The college also carries out risk assessments and identifies all risks and
hazards to make sure they are not at the high level because members would then get
injured. If there were no risk assessments then there would be developments of hazards
which could impose huge danger to people within the college. If the college did not follow
this law then there would be no detail within the college of which visitor came and which
visitor went and this could be dangerous when an emergency situation arises as the college
would not know how many visitors were within the college which would their safety and
welfare.

There would be developments of hazards which would put others into risk affecting their
safety, for example, the elevator could've developed into a hazard as it has got old and could
break, there could be staff in the elevator which would then be seriously injured and the
college would solely be responsible for it. If the college did not follow the Act and the health
and safety inspectors found out then they would turn up at the college as they have power to
come into the building and check if everything is okay, if they found dangers within the
college then the college would be given an improvement/prohibition notice and that area
would be sealed until the problem is sorted within the given days. If the college still doesn't
sort it then they could get fined and the college could get closed down completely. The staff
responsible for the health and safety could get taken in for an interview if there is too many
things wrong and they could face a fine and get given a warning.
