- Palliative care: serious conditions and does not address breach of duty

Psychiatric injury:
- X claim for psychiatric injury is likely to fail because it came upon her over a
period of weeks rather than as a result of a sudden shocking event
Insurance/ unnamed driver:
- Where there is a valid certificate of insurance in respect of the vehicle, the
insurers should accept the claim even if the accident involves a driver who
was not named on that certificate, providing the diver is identifiable.
- If not identifiable, the claim would be under the MIB Untraced Drivers
