Contract Law: Lecture One - Intro
to Contract/Influence of Covid 19
(19/10/21)
is a 'black-letter' subject makes up actual laws, which courts enforce, unlike 'soft
law' which is more to do with guidance

it is statute based - which is a piece of legislation passed by the state

In a sense is a very important part of law as we use contracts daily as a part of life;
we cannot avoid it

it is the foundation of other types of laws eg. property law as when a house is sold,
there is a lot of contractual processes

it regulates the market of goods and services; enforces promises

CONTRACT
generally a written document and is legally enforceable in which is breached will
come with a punishment. Often voluntary and is an agreement

— Wolfgang Friedman in Law in Changing society: ''contract supplied the legal
instruments which enabled men and goods to move freely''

WHY SHOULD COURTS ENFORCE CONTRACTS?
