Introduction

In this assignment I'll be explaining the legal and ethical issues in relation to the use
of business information. Secondly I'll be explaining the operational issues In relation
to the use of business information. Lastly I'll be analyzing the legal, ethical and
operational issues in relation to the use of business information and I'll be using
appropriate examples. The business that I'll be using is McDonald's for this task.

Legal issues refer to different legislation to protect the business information from
different source of hackers. The types of legal law that exists are data Protection Act
1998, freedom of information act 2000, Computer Misuse act 1990, Human Right
Act 1998 and Privacy Act 1974. The main three legal issues that I'll be discussing in
detail will be Data Protection Act, Freedom of Information Act 2000 and Computer
Misuse Act 1990.

Data Protection Act 1998 is the data Protection Act controls how your personal
information is used by organizations, businesses or the government.

Everyone responsible for using data has to follow strict rules called ‘data protection
principles’. They must make sure the information is:

 used fairly and lawfully
 used for limited, specifically stated purposes
 used in a way that is adequate, relevant and not excessive
 accurate
 kept for no longer than is absolutely necessary
 handled according to people’s data protection rights
 kept safe and secure
 not transferred outside the UK without adequate protection

In this case McDonalds follows all of these data protection principles to keep every
bit of information safe and guided so nothing goes wrong within the business or
outside of the business. McDonald's collect personal information such as names,
email address, billing address, delivery address, telephone number, credit card
details and this is all kept for the customer database. McDonald's complies with the
Data Protection Act 1998 by keeping the data from the customers secured so no one
from outside of the business has access to it, furthermore McDonald's are using the
data in a right method with helping them with their services. Furthermore this would
be very useful for McDonald's, because this act will be protecting all the McDonalds
staff information.

Freedom of Information Act 2000 The Freedom of Information Act 2000 provides
public access to information held by public authorities. It does this in two ways:
public authorities are obliged to publish certain information about their activities;

, and members of the public are entitled to request information from public
authorities.

This act would also affect McDonald's because the staff would not want all their
personal information to spread outside of the business. There are many examples of
this such as one of the staff members may have some sort of disability. The human
resources staff are not allowed to publish certain information or else they will get
sued and they will lose money. This act would make sure that McDonald's does give
enough information but not out of the context, moreover this would benefit
McDonald's as the information which McDonald's releases to the public it can attract
people to come and join McDonald's for work and business enquiries.

Computer Misuse Act 1990 The Computer Misuse Act 1990 (CMA) is an act of the
UK Parliament passed in 1990. CMA is designed to frame legislation and controls
over computer crime and Internet fraud. The legislation was created to:

 Criminalize unauthorized access to computer systems.
 Deter serious criminals from using a computer in the commission of a
criminal offense or seek to hinder or impair access to data stored in a
computer.

The Computer Misuse Act 1990 would be used by every business but in this case It's
used by McDonald's because this legal law was made to stop hackers from getting
personal details from people, business, governments and many more. Prior to 1990
all the hacking has started, hence why this type of act came into existence. This law
helps McDonald's to protect its information and data from hackers and other
exploitations such as viruses and trojans. Furthermore McDonald's would have some
sort of system to protect their business information such as Norton security and
enhancing the firewall to avoid any unauthorized hackers coming into the system.
McDonald's complies with this law by avoiding any sort of activity online by
installing the right software and system and also the employees to keep doing
regular checkups on the computer as the information which McDonald's hold is vital.

Ethical Issue is the moral principles concerning acceptable and unacceptable
behavior by businesses. Code of practice exists in organizations to maintain
business ethics on:

 Use of email
 Internet
 Whistle-blowing
 Organizational policies
 Information ownership

Use of email McDonald's like most companies would have code of practice when
regarding how to use email correctly and fairly in the workplace; some features of
fair and unfair of use of email are stated below:
