Employers have a duty to ensure safe practice for their employees. Maintaining health and safety is
essential in any work especially in a h&sc setting where the public may be at risk. This will have a
positive impact as it ensures protection for all servicers and employees.

There are policies which help employers and employees follow guidelines. The 11 legislations are the
health and safety act (1974) which was set up to reduce minimal risk towards employers and service
users. It applies in all workplaces. This further implies that service users and employers would
provide help if needed and give them the best care plan. This would positively affect them as it
ensures them safe practice. This promotes health and safety as employers and employees know
what good care looks like and are trained to recognize what bad care is and can apply the safety
rules to service users so they can get the best care possible. Another legislation is the data
protection act 1998 (DTA) which allows employers to keep services users' information confidential
unless asked with permission and other organisations if they want to do further research. This
promotes health and safety as they can decide what they want to do with their information as they
can fully access their information. Another reason it positively impacts them is that they can give it
to organisations who need to further their research as this can benefit them if they help relieve their
health issues in the future. Care standards act (2000) several standards that workplace have to live
up too for nursing, residential and domiciliary services. This promotes health and safety because
nurses have to follow guidelines allowing service users to know they are being treated well and are
safe and also have a positive impact on them as it allows them to know they are having the best
quality care and support from nurses/carers. The equality care act (2010) promotes anti-
discriminatory acts. This promotes health and safety as services users can be who they are without
being afraid someone will judge them. This will further have a positive impact on them as it allows
them to feel safe in the hands of the organisation/nurses as they are being treated fairly and equally.
The care act (2014) replaces existing acts. It helps support both service users and carers and cater
them before any incident/ crisis happens. This promotes health and safety as it ensures to protect
service users and prevent any incident that could potentially happen. This would positively impact
them as this solves any mishap and leave service users feeling eased and safe. The manual handling
operation regulations (1992) must solve any handling issues with dignity and only use equipment
when appropriate. This promotes health and safety as this will provide a healthier lifestyle as well as
eating the right foods. This will have a positive impact on them as they will feel healthy and their
health will not incline due to a poor diet so it will be one less thing to worry about. There are 13
Care quality commission acts. This means that everyone will have the right to uphold their dignity
and be respected and expected to be safe from safeguarding abuse and given the right proper care
such as food and drinks. This helps promote health and safety as it gives service users basic human
rights and allows them to be safe. This will have a positive impact as their dignity will be retained
and they have the freedom to do as they will without harming others. Discourse and barrier act is
important because it does not allow anyone with a criminal background to work within a health and
social care setting. This promotes health and safety as it protects staff and services from working a
potential criminal thus ensuring their safety. This will positively impact them as they won't have to
question anyone they work with or services for those who work for them. The food hygiene act is
preparation of food and for food to be made within clean backgrounds such as a clean kitchen so
they can make food with basic sanitary. This allows service users to be given proper food without
harming them. This promotes health and safety as carers will provide quality foods for service users
to eat and follow any requirements service users have. This will positively impact them as if they
have requirements such as veganism, carers will listen to them and provide a vegan meal so all
services users can enjoy a meal equally. Control of substance hazardous to health (COSHH)- control

, hazardous substances such as chemical/ medicine away from service users that may harm them. This
promotes health and safety as it protects service users from imminent threat. This would positively
impact them as they won't face dangerous situations. (RIDDOR)- requires employees to report a
incident or death or diseases within a workplace. This means that employees will have to report if
dangerous situations occur with service users that led to death or if diseases appear. This will
positively impact them as they will know the safety precautions so less people can die, or they can
report diseases, so it doesn't spread and potentially harm other staff members or users.



As we can see in the first case study, the health and safety act are not being promoted as the garden
gates are broken which allows service users to wander whilst having dementia. This is incredibly
dangerous as this puts service users in an exponential risk as they can get lost or end up in a harmful
incident. This risk can be reduced and improved if the care workers fix garden gates as the service
users are vulnerable so they can no longer wander off. This would have a positive impact on the
service users and employees as they won't wander off and employees won't have to worry about
whether they are gone or not and minimal threat will be imposed.



Care standards act is also not being practised as care workers have lied about where Elisa money
and recorded that her money had been found , this is morally wrong because nurses promised to fill
duty of care acts as one of them is giving excellent care to service users , instead of looking for it and
telling Elisa that it cannot be found , they have lied. Instead they should tell her they can’t find it and
that there is nothing they can do about it as it’s morally wrong. This would have a positive impact on
Elisa as she would be told the truth hence feel ease knowing the truth.



Another legislation not being practiced in Welling’s hospital is the health and safety act as the doors
being opened to anyone, this is imposing more threat as it allows anyone dangerous to just walk in.
In order to improve the h&sc setting, they should hire an appropriate person to fix the keypads so
minimal risk is reduced. Another legislation not being followed is the health and safety act as one of
their patients, Liz feels as if she can’t talk to them. People who are often abused stay silent as they
fear the consequences. If they followed the appropriate rules by logging in when she had bruised
and her medication, they could have noticed the obvious patterns of her hands being bruised and
gotten a different organisation involved that specializes and helps support services users. This would
have a positive impact on Liz as it may make her feel more supported enough to go get the help she
needs mentally too.

Legislations and policies improve services and influence safe practices to happen in a h&sc setting. It
helps those who work in h&sc to meet requirements and what is expected of them e.g. record
keeping.

Safeguarding policies and legislation influence practise by making it clear on what they do, and what
is allowed for safeguarding for vulnerable adults, children and young people. It’s also allowed
training for staff, so they know what they’re getting themselves into and how to handle certain cases
and fulfil their responsibilities as a carer. This will have a positive impact on them as staff/service
users will feel supported and protected by safeguarding and know they have their back.
