Sexual Offenses:
Rape (s1(1) Sexual Offences Act 2003)
o Actus reus: the penetration of another person's vagina, anus or mouth with D's penis and
when the victim does not consent
Penetration is a continuing act from entry to withdrawal (s.79(2))

o Mens rea: the intention to penetrate the victim in the absence of a reasonable belief in
consent. (Recklessness will not amount to a reasonable belief).
o Marital rape is now a crime. R v R [1991]
