Based on the given information about Henry, he is considered as an employee of the firm. As stated
above this situation or work condition is "a part of recession work plan" which means this arrangement
could be for a short term and he would need to be on call if there are any demand strikes, and once the
crisis over the company might resume the old routine again. Henry might also take notice that while the
other worker's wages would be affected due to short work hours, his salary might remain the same (as
there is no mention of his salary deductions during this recession workout and he is paid as regular
salary not per hour).

Forming a union would not be the best solution as this could lead the company to shut down and that
means Henry and other workers wouldn't have a job. During the recession, there would be little to no
chance to find a new job, especially Henry is also restricted under a non-competition agreement from
working for any other competitors for 5 years (except as a result of a layoff). Moreover, this action could
also impact the relationship between his wife and her sister as well as Ted’s job and his family.

In this scenario, instead of exercising his employee right, Henry may request the company to consider
his situation and allow him to not work on weekends. Instead, he could be available to handle the on-
call duties on weekdays or whenever the necessity arises. Or provide him accommodation in the
premises so that he can take care of his children during the weekends as well as work as required. The
company can demand him to take care of extra responsibilities during the stipulated working time as
well as ask him not to join the union as this might be harmful to the work culture from the
management's perspective. He might be asked to dissuade the other workers from forming a union.
