A man approaches a woman and says, " Give me all your money or I will kill you. " The woman gives the man all of her money. When he is apprehended minutes later after an immediate chase, a gun is found in the waistband of offender. Offense? - Armed Robbery A man on the street grabs a woman's purse. When the police arrive, thy find the offender gathering the belongings of the woman to steal them. Charge? - Burglary Absolute Liability - A person may be guilty of an offense without having one of the mental states if the offense is a misdemeanor which is not punishable by incarceration or by a fine exceeding $1000. According to Offenders interest in Property, can a co-owner commit theft against a co-owner? - YES Accountability for conduct of another - A person is responsible for conduct which is an element of an offense if the conduct is either that of the person himself, or that of another and he is legally accountable for such conduct. Exists when a person: a. Participates BEFORE the crime, with specific intent to promote or facilitate an offense. b. Participates AFTER the crime. c. Law provides that certain circumstances create possible defenses. (must present evidence). After Arnie kills co worker with his car, he realizes he might go to prison. Arnie decides to hide the dead body. Because the body is very heavy, he asks his friend Cara to help him bury it. Arnie tells Cara what he did and she decides to help him. Example: Joe and Bob are playing poker with some friends. Bob is losing and blames joe. Bob pulls out a gun, points it in Joe's face and says "I should shoot you, you cheater!" Aggravated Battery - When in committing a battery: a. based on great bodily harm b. injury to child or intellectually disabled victim c. location of conduct d. status of victim e. use of firearm (actually discharged) f. use of weapon or device g. certain conduct such as delivery of controlled substance. Aggravated Robbery - a. When he or she verbally or by his or her actions to the victim that he or she is presently armed with a firearm or other dangerous weapon, even if the offender does not in fact have a dangerous weapon. b. takes property from the person or presence of another by delivering (injection, inhalation, ingestion, transfer of possession) to the victim without his or her consent , or threat or deception for other than medical purposes of any controlled substance. Aggravated Vehicular Carjacking - When he or she violates Vehicular Carjacking and: a. victim is a person with a physical disability or a person of 60 years of age or older. b. A person under 16 is a passenger in the motor vehicle at the time of the offense. c. He or she carries a dangerous weapon or a firearm. d. personally discharges firearm in the event; if it causes great bodily harm, permanent disfigurement or disability, or death to another person. AIRA - Automated Incident Reporting Application Armed Robbery - Offender must have a dangerous weapon at the time of the robbery. If not capable of causing harm, the item is not a dangerous weapon. The offender need not use the dangerous weapon to be charged. If the victim perceives, at the time of robbery, that the offender has a dangerous weapon, and they in fact don't, this is the best charge. Higher than agg. robbery Arnie hates his co-worker. After work one day Arnie waits in the parking lot in his car. Seeing the co-worker exit the building, Arnie speeds up and purposely runs the man over, killing him instantly. What charge? - First degree murder Arnold is a truck driver. Arnold delivers crates of apples for his employer. As he is unloading the goods he has transported for his employer, Arnold puts several crates in his own car and intending to take them home to eat. Arnold knows he is not authorized to do this. At 3 am one morning, mac sneaks into and hides in an office building. He intends to wait in the office until the following morning, at which he intends to shoot and kill one of the employees. Offense? - Burglary Attempt - 1. With the intent to commit a specific offense, 2. does any act which constitutes a substantial step towards the commission of the offense. Even numbered beats are "late car" 3. 277 total in Chicago Bob stays at hotel overnight with annie. They have a good time, but no money. They decide to leave the next day without paying. Charge? - Theft of labor or services Bobby goes to store to buy some toys for her baby. She finds a teddy bear that she likes but it costs $50, which is too expensive. She changes the price tag so that it says $10 and goes to the register to pay. After paying for it , bobby intends to leave the store. Charge for Bobby? - Retail Theft Boundaries - 1.
