The legislation currently governing the attorney’s profession in South Africa is the Legal
Practice Act 28 of 2014 (LPA). 2 The Act replaced the Attorneys Act 53 of 1979 and
unified the previously separate regulation of attorneys and advocates into a single
statute. The LPA modernises the legal framework by:
• Establishing the Legal Practice Council;
• Prescribing requirements for admission, enrolment, and practice; and
• Emphasising accountability through mechanisms such as Fidelity Fund
certification.
