1.1 What does the acronym TWAIL stand for?
TWAIL stands for Third World Approaches to International Law. It is not simply a
descriptive label, but an ideological and methodological critique of international law’s
Eurocentric development and application. TWAIL provides a framework for analyzing
how international legal systems have historically served colonial and imperial interests,
often at the expense of Third World states. It enables scholars and practitioners to
question whose interests the law represents and how power relations are embedded in
legal doctrines. The relevance of TWAIL lies in its ability to reinterpret legal concepts
such as sovereignty, intervention, and development from the vantage point of formerly
colonized nations.
1.2 What informed the development of the TWAIL movement?
The development of TWAIL was informed by a convergence of historical realities,
intellectual critiques, and political struggles. The key drivers of this movement include:

TWAIL identifies how classical international law legitimized colonial expansion through
doctrines such as terra nullius, which declared colonized lands as legally "empty" and
thus open for occupation. This historical foundation reveals that international law did not
