individuals with different needs


Legislation Summary

Human Rights Act 1998 ● Means that all individuals must be treated equally, fairly,
dignifiedly, and with respect by public institutions such
as the government, police, hospitals, and local council.
● gives everyone the ability to use UK courts to defend
their rights.
● Outlines the basic liberties and rights that people in the
United Kingdom are entitled to, such as the freedom of
thought and expression and the right to be free from
discrimination.


Mental Capacity Act ● People over the age of 16 who might not have the ability
2005 to make their own decisions regarding their care and
treatment are protected and given power by this law.
● It states that people must be provided with the
assistance they need to make a decision on their own.
● Should specify that when giving the necessary care and
treatment, treatment and care should be given with the
least amount of restriction on their fundamental
liberties and rights as practicable.


National Health Service ● Act passed to enhance health services for both mental

Equality Act 2010 ● Safeguards individuals from discrimination at
employment and in the larger community.
● Assures consistency in creating a more equitable
workplace for both businesses and employees.
● Outlines the methods that discrimination is prohibited.


Care Act 2014 ● Is to provide clearer, more equitable care and support
for both the person in need of care and the person
providing that care.
● Aims to expedite the delivery of care if necessary.
● Grants individuals autonomy over their treatment.




The UK passed the Human Rights Legislation in 1998. Individuals are able to defend their
rights in UK courts, and it requires public institutions like the government, police, and local
councils to treat everyone equally, fairly, and with respect. (Liberty Humanrights.org)
Fairness, Respect, Equality, Dignity, and Autonomy is the acronym for FREDA (choice and
control). These principles, which incorporate provisions from the 1998 Human Rights Act
and are in line with the 2010 Equality Act, are thought to serve as the foundation for all
international human rights treaties (CQC). E.g for fairness, Health Professionals in a health
and social care setting must give the other service users viewpoint appropriate regard and
provide them the chance to express and be heard.

B.D2: Justify the strategies and techniques used to overcome ethical issues and
challenges experienced by individuals with different needs when planning and providing
care

It can be challenging to decide which ethical strategy is best. The Mental Capacity Act of
2005, can help Nurses decide on the best course of action. This law aids the Nurse in
determining whether the service user is capable of making decisions on their own or if the
professional must make a well-informed decision on their behalf. The law can be applied to
service users who are in poor mental health and intends to strengthen the role of the
practitioners as caregivers. Due to Tremayne's autism and the likely difficulty he may have
