Learning Objective 2: What are the rules/legislation for countries for
closing/opening their borders?
- Option 1: Art 25 SBC; General framework reintroduction border (used in a foreseeable
event, like world cup football)
o 1 serious threat, up to 30 days or for the foreseeable duration of serious threat
o 2 as a last resort,
o 3 may prolong if serious threat persists, and taking 26 (proportionality) and 27 SBC
(procedural obligations (a-e)) in account
o 4 shall not exceed six months
- Option 2: Art 28 SBC; Immediate action (used in case of a terrorist attack for example)
o 1 Serious threat requires immediate action, MS may on exceptional basis
immediately reintroduce border control, up to ten days
o 2 Notify MS and commission and comply with art 27 (1) SBC
o 3 If serious threat persists, MS may prolong with renewable periods of 20 days,
taking art 26 SBC (proportionality) into account
