TLI4801 ASSIGNMENT 1 SEMESTER 1 FOR 2024-
TECHNIQUES IN TRIAL AND LITIGATION. 90%
AND ABOVE. DISTINCTION GUARANTEED.
QUALITY WORK WITH FOOTNOTES AND
BIBLIOGRAPHY.

QUESTION 1
(a)
The purpose and objectives of the interview with Mrs. M, as well as exchanging
pleasantries, serve several important functions in the context of providing legal advice
and representation. This is explained below.

Firstly, the interview serves as a platform to establish rapport between the advocate and
Mrs. M. As a legal practitioner, it is essential to recognize the emotional and
psychological impact such events can have on individuals. Mrs. M is likely to be
distressed and anxious about the accident and its consequences. Therefore, by
exchanging pleasantries and engaging in casual conversation, the advocate can create
a welcoming atmosphere that puts Mrs. M at ease, allowing her to open up about her
experiences and concerns more freely.1

Moreover, the interview facilitates the gathering of crucial information pertinent to the
legal case. While formal questioning and documentation are essential, the relaxed
atmosphere of exchanging pleasantries can often elicit details that might not emerge
through direct interrogation alone. 2 Through active listening and empathy, the advocate
can gain a comprehensive understanding of the circumstances surrounding the
accident, including Mrs. M's perspective on the events leading up to the collision, the
extent of the damages incurred, and any other relevant factors that may impact the
case.
