P3- Explain how one piece of legislation, one policy and one code of practice could be applied to
planning support to individuals.

Legislation is formed by parliament, it is there to ensure that individuals are aware of their rights
when it comes to a health and social care setting. Every health and social care setting must comply
to these legislations as it keeps them from conducting poor practice.

The data protection act 1998 would be used when caring for a patient. This act states that all
individuals should receive confidentiality when it comes to their personal health records. The
individual may feel a lack of trust within the health service if this piece of legislation is not abided by.
If this legislation is not followed then the patient’s person records could get stolen and fall into the
wrong hands. An example of how this may happen would be of the individual in charge of these
records left the information out in a busy area, or shared the password that gains access to the
records with others. This will put patient’s wellbeing and safety at risk. Therefore, it is important that
the patient’s information is only shared with authorised individuals, this will minimise the risk of this
act being breached.

Each health setting should have policies which ensure that everyone has equal opportunity, this will
make sure that each patient is valued. A policy is made up by using legislation, it is a code that staff
members must carry out. a risk assessment may be carried out when providing care for a patient.
This is possible hazards are identified, a written risk assessment must then be completed, this brings
to light how many risks are about. Following this, a company called Healthy Working Lives help staff
members to include all areas of health, safety and well-being into their work environment. It is
thought that each health professional would then be able to identify risks within their environment,
and remove them to prevent injury to others. An example of this may be if a resident has become
agitated and is physically abusing staff members, they would then be considered a risk to themselves
and others. So, the trigger to these outbursts must be identified to ensure that there are not future
displays of dangerous behaviour.

codes of practice are guidelines that are published by a professional organisation. It encourages its
employees to follow these codes as it covers ethical values. each health care professional should
receive an induction before getting the job. This induction will train the individual until they are
qualified to fulfil the job role. Professionals should have a valid DBS (Disclosure and Barring Service)
it confirms that they are safe to be around in a health or social care setting. These should be
updated frequently as it keeps service user’s safe.
