(a) Prosecutorial bail is not appropriate in the case of Allan Fuse. Prosecutorial bail, as provided for
in section 59A of the Criminal Procedure Act 51 of 1977, is limited to relatively minor offences and
may only be granted before an accused first appears in court, usually at a police station or
prosecutor’s office. Arson is a serious Schedule 5 offence, involving intentional conduct, extensive
property damage, and a high risk to public safety, even though no injuries occurred. Because of the
seriousness of the offence, the likelihood of a substantial custodial sentence upon conviction, and
the strong prima facie evidence based on eyewitness accounts, the decision to release Mr. Fuse
cannot be left to the prosecution alone. Marnewick explains that serious offences involving
violence, significant damage, or public danger require judicial oversight, making court-based bail
proceedings mandatory rather than prosecutorial bail (Marnewick, C.G., 2024, pp. 214–216).

(b) Before releasing an accused on bail, a court must consider whether the interests of justice
permit such release, as set out in section 60 of the Criminal Procedure Act. Relevant factors include
the likelihood that the accused will stand trial, the risk that he may interfere with witnesses or
evidence, the danger that he may commit further offences, and whether his release would
undermine public confidence in the criminal justice system. The court must also consider the
seriousness of the offence, the strength of the prosecution’s case, and the personal circumstances
of the accused, such as fixed address, employment, and family ties. In Mr. Fuse’s case, the
seriousness of arson, the extent of damage, and the existence of eyewitness testimony weigh
heavily against release. Marnewick notes that bail is not a right but a judicial discretion exercised
by balancing the accused’s liberty against societal interests and the proper administration of justice
(Marnewick, C.G., 2024, pp. 216–219).

(c) A sentence agreement concluded in terms of section 105A of the Criminal Procedure Act allows
the prosecution and the accused, assisted by legal representation, to agree on a plea and an
appropriate sentence, subject to court approval. The court retains a supervisory role and must be
satisfied that the accused entered into the agreement freely and voluntarily, understands its
consequences, and that the proposed sentence is just and proportionate. If the court accepts the
agreement, it is bound by its terms and must impose the agreed sentence; if it rejects the
agreement, the trial must start de novo before a different presiding officer. Marnewick explains
that section 105A promotes efficiency, reduces trial delays, and provides certainty, but it does not
undermine judicial independence because the court remains the final arbiter of fairness and
legality (Marnewick, C.G., 2024, pp. 303–306).

(d) An application for separation of trials may be made where two or more accused are jointly
charged, but a joint trial would result in prejudice to one or more of them. Circumstances justifying
separation include where the defences of the accused are mutually destructive, where an
admission or confession by one accused implicates another, or where evidence admissible against
one accused is inadmissible and prejudicial against the other. The court exercises a discretion and
must balance procedural convenience against the accused’s right to a fair trial. Marnewick notes
that separation of trials is granted sparingly and only where real, not speculative, prejudice is
shown, as joint trials generally promote consistency and judicial economy (Marnewick, C.G., 2024,
pp. 54–56).
