QUESTION 1 AND 2 ARE BASED ON THE ACT. Question 1 (a) The Act was adopted on 5 April 1996, assented to by the president on the 10 April 1996, but it only commenced on 19 June 1996. EXPLAIN the difference between the dates of assent and commencement with reference to the provisions of section 13 of the interpretation Act 33 of 1957. Make a list of at least three internal aids that can be consulted and give an example of each from the text of the Act (where possible). The Commission argued that in terms of section 5(1) it states that “members of the Commission shall hold office for a period not exceeding five years”. Advise the Commission on this argument by briefly explaining to him HOW peremptory provisions differs from directory provisions, and WHETHER the appointment complied with the statutory requirements (refer to at least two examples from the relevant case law). (10) Question 3 (a) EXPLAIN the different methods of computation of time (specifically the ordinary civil method and with reference to relevant case law case law). (8) Question 4 (a) Briefly discuss the impact of the interpretation clause of the Constitution (article 39(2)) on the approach adopted by courts when interpreting statutes (refer to relevant case law in your answer). Interpretation of Statutes

Question 1
(a) The difference between the date of assent and the date of commencement is
significant in statutory interpretation. The date of assent refers to when the President
formally approves the legislation, making it an official Act. However, the Act does not
necessarily come into effect immediately upon assent. The date of commencement
refers to when the Act becomes legally binding and enforceable. According to Section
13 of the Interpretation Act 33 of 1957, unless an Act explicitly states otherwise, it only
comes into effect on the date determined by the legislature or the relevant government
authority.

(b) The purpose of the Act can be determined using internal aids, which include:

1. The Long Title – This provides an overview of the Act’s objectives. Example:
"An Act to establish a National Youth Commission..."
2. The Preamble – It outlines the rationale behind the legislation. Example: The
preamble may describe the need for youth empowerment and representation.
3. Definitions and Interpretation Clauses – These clarify key terms used in the
Act. Example: The definition of "Commission" within the Act ensures consistency
in interpretation.

(c) The long title of the Act is: "To provide for the establishment of a National Youth
