QUESTION 1 AND 2 ARE BASED ON THE ACT. Question 1 (a)The Act was adopted on 5 April 1996, assented to by the president on the 10 April1996, but it only commenced on 19 June 1996. EXPLAIN the difference between the dates of assent and commencement with reference to the provisions of section 13 of the interpretation Act 33 of 1957. (10) (b)How should the purpose of the Act be determined? Make a list of at least threeinternal aids that can be consulted and give an example of each from the text of the Act (where possible). (6) (c)IDENTIFY the long title of the act and explain why the long title is important forstatutory interpretation. (6) Question 2 (a)James was appointed by the President as a member of the Commission for aperiod of six years. The Commission argued that in terms of section 5(1) it states that “members of the Commission shall hold office for a period not exceeding five years”. Advise the Commission on this argument by briefly explaining to him HOW peremptory provisions differs from directory provisions, and WHETHER the appointment complied with the statutory requirements (refer to at least two examples from the relevant case law). (10) Question 3 (a)EXPLAIN the different methods of computation of time (specifically the ordinarycivil method and with reference to relevant case law case law).
