(3) (b) Name the elements which must be present to constitute the crime of false disparagement of goods and services and give an example from case law. (5) (c) Name four (4) grounds upon which the provision of records may be refused in terms of the Promotion of Access to Information Act 2 of 2000. (a) Classification of Publications Under the Films and Publications Act 65 of 1996

Under the Films and Publications Act 65 of 1996, publications are reviewed and
classified to ensure they are appropriate for different audiences.

Possible classifications

1. "X18" Classification: This is given to adult content, such as material that shows
explicit sexual conduct. This classification is for publications that are only
intended for adult viewers, meaning no one under the age of 18 should access
them. The idea is to protect children and young people from being exposed to
material that might be harmful or inappropriate for their age.
2. "Refused Classification": This is a step further than "X18" where the material is
considered so harmful that it should not be distributed at all. This includes
content that might incite violence, promote hatred, or include extremely graphic
violence or sexual content that’s beyond acceptable limits. This classification
means the publication cannot legally be sold or distributed within South Africa.
