Ideas on improving bail provisions to better protect society from GBV
Idea 1: Enforce stricter bail conditions for GBV offenders.
Motivation: Courts should impose strict conditions such as curfews, electronic
monitoring, and restraining orders. These conditions prevent the accused from
contacting the victim or returning to shared spaces. This is important because it helps
reduce the risk of repeated violence and ensures the victim’s safety during the
investigation process.
Idea 2: Deny bail to repeat GBV offenders or those with prior violent conduct.
Motivation: People who have previously been accused or convicted of gender-based
violence should face tighter restrictions when applying for bail. This measure
discourages repeat offences and sends a clear message that society will not tolerate
habitual abuse. It also helps protect victims and potential future victims from further
harm.
Idea 3: Introduce victim impact assessments before bail decisions.
Motivation: Courts should consider the emotional, physical, and psychological impact
