Due Date: April 2026
QUESTION 1
Briefly explain the three forms of acquiring citizenship in South Africa.
Citizenship by Birth
Citizenship by birth is one of the main ways in which a person becomes a South African
citizen. A person qualifies for citizenship by birth if he or she was already recognised as a
South African citizen by birth before 1 January 2013. A child also becomes a citizen by birth
if born in or outside South Africa and at least one parent is a South African citizen at the time
of birth. In some cases, a child born in South Africa to foreign parents may also qualify if the
child has no other nationality, or if the parents have permanent residence and the child has
lived in South Africa from birth until becoming an adult, provided the birth is properly
registered under the Births and Deaths Registration Act (CPD1501 Study Guide, 2026).

Citizenship by Descent
Citizenship by descent applies where citizenship is obtained through family lineage.
A person qualifies if he or she was already a South African citizen by descent before
1 January 2013. It also applies to children adopted legally by South African citizens,
as long as the adoption and birth registration meet legal requirements. In this case,
citizenship is linked to ancestry or legal parental relationship rather than place of
birth. This form ensures that children connected to South African citizens through
blood relation or lawful adoption may also become citizens (CPD1501 Study Guide,
2026).
Citizenship by Naturalisation
Citizenship by naturalisation is granted to foreigners who meet legal conditions and
are formally accepted as South African citizens. This usually applies to adults who
have permanent residence in South Africa and have lived in the country for the
required number of years. Applicants must show good character, knowledge of one
official language, understanding of citizenship duties, and intention to remain in
South Africa. They must also make a declaration of allegiance. Naturalisation allows
