The constitutional right to privacy protects individuals against unlawful intrusions into
their personal and digital lives. Social media complicates this right because users
disclose personal information voluntarily, often without fully understanding how
platforms collect, analyze, and monetize their data (Solove, 2021). Corporations track
behavior through algorithms and share insights with third parties, reducing individuals’
control over their digital identities. Moreover, governments and employers increasingly
use social media for surveillance, blurring boundaries between private and public life.
While privacy once referred primarily to physical spaces, it now extends to digital
communication, metadata, and personal expression online. This evolution challenges
courts to redefine privacy, emphasizing consent, transparency, and data ownership.
Failure to adapt erodes credibility, legitimacy, and ultimately the protection of privacy in
modern society.
