Case Study 1: Bianca’s Pastry Shop
1.1 Missing or Incorrect Information in Bianca’s Affidavit
Bianca’s affidavit contains omissions and inaccuracies that need to be corrected to
ensure the statement is legally sound, factually accurate, and admissible in court. The
following information should be revised or added:
1. Date and time of offence – The affidavit must clearly state that the incident took
place between 04:00 and 05:30 on 18 August 2025, during a load-shedding
period.
2. Exact location – The business premises should be fully described: Bianca’s
Pastry Shop, Berg Shopping Centre, 22 Long Road, Umhlanga.
3. Method of entry – It must be recorded that the lock on the front door was forced
open, leaving the door partly ajar.
4. Property stolen – A complete inventory of stolen goods must be included: 20
brown loaves, 25 white loaves, one pink birthday cake, a 10-litre Samsung
microwave, a 9kg Cadac gas cylinder, assorted pies, rusks, deli products, and
Bianca’s branded plastic bags.
5. Value of property – An estimated total value of the stolen property must be
documented for both insurance and criminal proceedings.
6. Discovery of the crime – Bianca should note that she pushed the door open
using her scarf to avoid contaminating possible forensic evidence.
7. Alarm system details – The affidavit should explain that Bianca received an
SMS notification at 04:00 indicating that the alarm failed to activate due to load-
shedding.
8. Witness account – A car guard observed the suspects, Carel Brits and Jabulani
Khoza, carrying Bianca’s branded bags. The suspects were seen eating bread
and attempting to sell a cake and microwave.
