Question:
Bakery Workers Association (‘BWA’) is a registered trade union which represents
some employees within Biscuit Bakery (Pty) Ltd (‘BB’). BWA approaches BB to
acquire various organisational rights within the workplace. Describe various
methods which BWA may use to acquire organisational rights within BB. [10]
In terms of the Labour Relations Act 66 of 1995 (LRA), a registered trade union such
as BWA may use the following methods to acquire organisational rights at Biscuit
Bakery (BB):
1. Collective Agreement
o BWA may negotiate directly with BB and conclude a collective agreement
granting organisational rights.
o This is often the most efficient way, as it avoids disputes.
2. Statutory Rights in the LRA
o If BB refuses, BWA may rely on sections 12–16 of the LRA, which
provide specific organisational rights, including:
Access to the workplace (s 12).
Deduction of trade union subscriptions (s 13).
Election of trade union representatives/shop stewards (s 14).
Leave for trade union activities (s 15).
Disclosure of relevant information for collective bargaining (s
16).
3. Threshold Agreements
o Organisational rights may also be acquired if BWA meets or exceeds the
threshold of representativeness (majority or sufficiently representative)
agreed in a collective agreement with BB.
4. Referral to the CCMA (Commission for Conciliation, Mediation and
Arbitration)
