Tiisetso Kefilwe Daisy Moleme was employed as a chemist by Induradec Coatings. In March
2023, twelve weeks pregnant, she requested relocation from the laboratory due to chemical
exposure concerns, particularly to Bisphenol A.1 She was moved to an adjacent office
without any duties and later informed that, due to a lack of alternative positions, she would
be placed on extended unpaid maternity leave.1 Despite her objection and reference to
section 26 of the Basic Conditions of Employment Act 75 of 1997 (BCEA),1 the company
proceeded with the leave. Moleme, financially impacted, lost her home and vehicle and
relocated to Gauteng.1 She referred a dispute to the CCMA, which issued a certificate of
non-resolution, and she instituted proceedings in the Labour Court under section 10 of the
Employment Equity Act 55 of 1998 (EEA), claiming pregnancy discrimination and non-
compliance with section 26 of the BCEA.1
