What is the Protection for Persons in Care Act (PPCA)? - Answers :■Law promoting
prevention and reporting of abuse of adult Albertans who receive care or support
services
-Services funded by Government of Alberta
■Directly or indirectly

The 3 criteria of the Mental Health Act - Answers :1.The person is suffering from mental
disorder
2.The person is likely to cause harm to self or to suffer substantial mental or physical
deterioration or serious physical impairment, and
3.The person is unsuitable for admission to a facility other than as a formal patient


All 3 criteria must be present in the opinion of a physician in order for the physician to
sign the certificate.

OR
-The formal patient is unsuitable to continue at a facility other than as a formal patient
(in the case of a renewal certificate).

Formal Patient - Answers :■a patient detained in a facility under the Mental Health Act
on the authority of two admission certificates or two renewal certificates

Informal Patient - Answers :■voluntarily seek treatment or admission to hospital

Mental Disorder: - Answers :a substantial disorder of thought, mood, perception,
orientation or memory that grossly impairs;
-Judgement
-Behaviour
-Capacity to recognize reality, or
-Ability to meet the ordinary demands of life

Compulsory Admission - Answers :■The physician completes a Form 1: Admission
Certificate
■The person can then be held for 24 hours within which
■A second physician completes a second Form 1: Admission Certificate
■The person can then be held for up to 1 month
■Note - neither physician has to be a psychiatrist
■A person can be brought from the community to a facility by a Peace Officer under a
Form 10

Community Treatment Orders (CTO) - Answers :■Intended to support people in the
community with severe and persistent mental disorder who have history of non-
compliance with treatment

■Treatment plan under supervision of psychiatrist, which person is involved in making
or at least informed of

■Person can be apprehended on psychiatrist order if fails to comply

■Person has right to request review

Community Treatment Orders (CTO) - Answers :■All Treatment/Care must be available
and patient able to comply for CTO to continue
■CTO is in effect for six months after issue (M)
-Automatically expires unless 2 physicians renew (one must be psychiatrist or
designated physician). May be renewed every 6 months, unlimited renewals.
■Automatic Review Panel Hearing on the first renewal (after 6 months) and every
second renewal (12 months) after that •
■Patient (or SDM) may request a Review Panel hearing to cancel a CTO •
■Patient may access MH Patient Advocate services at any time while on a CTO
-Facility" means a place or part of a place designated in the Mental Health Regulation
as a facility, otherwise known as designated facility

Patient Rights/Staff Obligations - Answers :■The person has to be given a copy of the
Admission Certificates and have the reason for the compulsory admission explained to
them

■They have to be given verbal and written information about the review process and the
Mental Health Advocate's office
