1. What sanctions are available to be used against an attorney who is found to be in
violation of their jurisdiction’s rules of conduct? List and define them.
The four sanctions that are available to be used against an attorney who is found to be
in violation of their jurisdiction’s rules of conduct are reprimand, probation,
suspension, and disbarment. The mildest sanction is reprimand, also known as
reproval and this type of sanction is a warning or slap on the hand letting the attorney
know that the conduct at issue will not be tolerated. Probation is when the attorney
may continue to practice on the condition that certain requirements are met. This may
include restitution for injured clients, passing an ethics exam, attending ethics school
and so on. Suspension is when the attorney is deprived the right to practice law for a
specified period of time. Disbarment, which is the most severe sanction, is when a
lawyer’s license to practice law is revoked.
2. The textbook gives primary arguments against licensing of traditional paralegals. List
3 of those arguments. Only list 3.
Three of the primary arguments against licensing of traditional paralegals contend
that licensing would increase the cost of employing paralegals and therefore increase
the cost of legal services, inappropriately limit entry into the profession, and restrict
the movement of paralegals into new areas of practice or duties.
