Sammy was employed as a Forensic Analyst by ABC (Pty) Ltd. He was hired to do
work for the Department of Justice, which contracted ABC (Pty) Ltd for an investigation.
In April 2022, ABC (Pty) Ltd retrenched Sammy and paid his severance package. In
October 2022, the Department realised that it still required the services of Sammy.
However, it was neither permissible to appoint him directly, nor to hire him through ABC
