1. Differences between Criminal and Civil Cases in the Republic of South Africa (2
Marks)

Criminal cases involve the prosecution of an individual or entity by the state for an act that is
considered a crime against society, such as theft, assault, or murder. The primary objective is
to determine guilt and, if found guilty, to impose a penalty such as imprisonment or fines.

Civil cases, on the other hand, involve disputes between private individuals or entities. These
cases typically deal with issues such as contracts, property disputes, or family law matters.
The primary objective in civil cases is to resolve the dispute and, where applicable, award
compensation or other remedies to the aggrieved party.
