Environmental Law
Question 1
List and provide examples of environmental sector-specific legislation that
addresses (directly or indirectly) climate change issues in South Africa.
South Africa has several laws that tackle environmental issues, including climate
change, either directly or indirectly. These laws help regulate activities that contribute to
climate change, promote sustainable practices, and protect the environment. Some key
examples include:
1. National Environmental Management: Air Quality Act (No. 39 of 2004)
o This law aims to control air pollution by setting limits on greenhouse gas
emissions. It regulates industries that contribute to air pollution, ensuring
they take responsibility for reducing their environmental impact.
2. National Environmental Management Act (NEMA) (No. 107 of 1998)
o NEMA is a broad environmental law that ensures sustainable
development. It requires Environmental Impact Assessments (EIAs) for
projects that could harm the environment, including those that contribute
to climate change.
3. National Climate Change Response White Paper (2011)
o This policy sets out South Africa’s approach to dealing with climate
change. It outlines strategies to reduce carbon emissions and prepare for
climate-related disasters like droughts and floods.
