Explain the impact of the legal and regulatory framework on
recruitment and selection activities.
In this assignment I am going to explain the impact of the legal and
regulatory framework on recruitment and selection activities.
Sex Discrimination Act 1975/97
Explanation of act: This act makes it law that man and women are
treated equally. For example a qualified man cannot be chosen over
an less qualified woman.
Example which I found: Published on the 4th of March 2019 by El Pais
(a Spanish newspaper). The Spanish government has approved a
legislation with which they want to fight gender discrimination. The
legislation demands Spanish businesses to hand in a registry in which
they prove that they have; average salary value, salary supplements
and non-wage benefits. The goal of this registry is to find out whether
female workers are threated equally with man and if there is any
under payment for woman or gender wage gap. Not all company’s
need to hand in a registry. Businesses with over 250 employees must
hand in a registry in the first year of the law, the second year
company’s with over 100 must hand in the registry and within three
years the minimum employee target will be set to 50 employees. The
Spanish government applied this law because they have noticed men
get often more paid then woman even though they are performing
the same job. In Spain women’s hourly earnings are 12.7% lower than
man`s earnings.

Race Relations Act 1992
, Explanation of act: This act makes it a law for anyone to be
discriminated against the color, race, nationality or origin.
Example which I found: Published on the 21th of March 2019 by
Inside Highered. A professor from the University of Maryland College
Park named David Weber was resigned from his job after accusing an
group of Chinese students for cheating based on their race and
origin. In the complaints submitted to the Office of Civil Rights and
Sexual Misconduction, the discriminated students said that Weber
came walking into class with a note of students who were being
suspected for cheating on the general exams. and started yelling
discriminating things such as; All Chines students cheated their way
into the U.S.

Equal Pay Act 1970
Explanation of act: This act makes it a law that man and women
should be paid equally.
Example which I found: Published on the 31th of January 2019 by
newspaper Independent. Asda employees have won a legal battle
with their employer over equal pay. A sum of £10bn will be paid back
to current and former retail staff members. Shop floor staff which are
often woman are paid less than men. According to the lawyer of the
staff members the case isn’t closed yet. First will be found out
whether shop workers and distribution centre roles are of equal
value and what the reason is behind sexual discrimination for not
paying these roles equally.
