Your assignment must be presented in the following format: • Cover page • Table of contents (1) • Answers with references • Correctly completed reference list Case study: Four suspects were arrested for tampering with infrastructure after they were caught digging up a cable in Heidedal in Bloemfontein. On Wednesday, 8 May, at about 21:00 members of the Bloemfontein Flying Squad followed up on information about suspects stealing cables in an open field in Heidedal. Members rushed to the scene and upon arrival they asked for a drone belonging to a security company to determine where the suspects were. Four suspects were spotted. Members acted swiftly to close off the area and managed to arrest [two] suspects. Members also recovered two cellphone, shovels, hacksaws, gloves, pliers, and other equipment, as well as a 5-meter-long cable that had already been cut. Additionally, it was discovered that approximately 60 meters had already been dug up, and the cable had been removed (Bloemnews, 2024). Additional information added by the lecturer: You are an investigator at Heidedal Power Company. You are tasked to assist the SAPS with the investigation, as the damaged and stolen property belongs to the 2 Heidedal Power Company. Upon viewing the Drone footage, you notice that two suspects escaped from the scene in a Red LDV. They drove off in the direction of Colesburg. Answer the following questions, based on the information from the case study. Question 1 Question 1.1 The starting point of any investigation is the Locard theory. Explain in your own words what this theory means, and who discovered it. (5) Question 1.2 Identify at least THREE pieces of evidence to which the Locard theory will apply. Motivate your answer. (4) Question 1.3 The Lochner principle is a well know technique used by the modern crime investigator. Explain the Lochner principle in your own words, including when it was ‘discovered’ and by whom. (5) Question 1.4 Identify the evidence at the scene to which the Lochner principle will apply. Motivate your answer. As investigative strategy, you decide to conduct physical, mobile surveillance at THREE local scrap metal dealers, known for dealing in stolen goods. Question 2 Question 2.1 Using the information from the case study, list any FIVE objectives that such a surveillance operation would cover. Marks will not be allocated for general objectives not related to the case study. (5) Question 2.2 Identify any two advantages and any two disadvantages of this specific surveillance operation. Neither of them is fluent in English: both have asked for an interpreter. Discuss in your own words whether it is permissible for you as the investigator to be involved in the pointing out. In your answer, you must address the following elements: • What is a pointing out? (3) • What is the evidential value of a pointing out? 4 (3) • What are the admissibility requirements of a pointing out? (5) • Who should be doing the pointing out? (4) While your answer must NOT address the activities of the various phases, it must demonstrate a clear understanding of the legal framework that governs the pointing out of crime scenes. The starting point of any investigation is the Locard theory. Explain in your
own words what this theory means, and who discovered it.

The Locard Principle of Exchange, formulated by Dr. Edmond Locard, a French
criminologist, in the early 20th century, is a foundational concept in forensic science.
The principle asserts that "every contact leaves a trace," meaning whenever a
person comes into contact with another person, object, or location, there is a mutual
exchange of materials. This exchange can involve fibers, skin cells, hair, or other
forms of trace evidence. Locard’s principle underpins the investigative process by
enabling investigators to link a suspect to a crime scene or victim through the
physical evidence left behind (Mokwena,6).

While the Locard Principle remains a crucial guideline, developments in technology,
particularly in digital communications, have introduced new dimensions to criminal
investigations. For instance, the advent of mobile phones has created additional
means of tracing suspects, such as through mobile handset signals. Modern
communication networks continuously record the location of a handset whenever it is
active, whether making a call, sending a text, or even when switched on but not in
use. This data, stored remotely in-network provider databases, allows law
enforcement to track suspects’ movements and establish their presence at a crime
scene without needing physical traces (Mokwena,6).

The reliance on cell phone evidence highlights the evolving nature of forensic
methods. For example, Inman and Rudin (2001:94) suggest that while Locard's
principle remains unchallenged, it should be tested and expanded scientifically to
accommodate these technological advancements. The Lochner Principle,
established in 2006 and patented in 2010, extends Locard’s concept to include
digital traces, particularly those related to mobile phone technology. This new
principle affirms the validity of the Locard Principle in the context of modern
investigative techniques and highlights the indispensable role of digital evidence in
forensic investigations (Mokwena, 2024:6).
