(a) Case Name: Amod v Khan 1947 (2) SA 432 (N)
Ratio decidendi of the case: The court in this case highlighted that when someone
applies for sequestration (a legal process where a debtor's estate is declared
insolvent), the application should specifically address the individual debtor’s situation.
The intention is to reduce the debtor's legal status and capacity, so it should only
focus on that debtor's circumstances.
