Mzansi Workers Association (‘MWA’) is a trade union with members
employed by both RR Manufacturers (‘RRM’) and SS Gas (Pty) Ltd
(‘SSG’). SSG supplies RRM with gas which RRM uses to manufacture its
products. After members of MWA employed by SSG heard that members
of MWA employed by RRM are on strike due to a dispute relating to their
shift system, they also decide to go on strike to support employees of RRM
who are on strike. Discuss the nature of the strike which employees of SSG
want to engage in and the requirements which should be met for the strike
to be protected.
The scenario presented involves a secondary or solidarity strike, where
employees of one company (SSG) want to strike in support of employees
of another company (RRM) who are already on strike. The legality and
