The student will identify characteristics unique to law enforcement driving. - Complying with State Law and Agency Policy Public reaction to law enforcement vehicles Using radio communications during normal and emergency driving Driving under stress Driving with distractions (prisoners, suspects, etc) Driving on patrol (observing cars, buildings, people; wanted lists; listening to radio) The student will identify statutory law, case law, and the principles of liability governing non-emergency, emergency, and pursuit driving law enforcement officers, supervisors, and agencies may be held civilly liable for injuries arising from law enforcement driving activities. - A. State Statute Requirements - Non-Emergency Driving 1. Oklahoma has no statutes that specifically govern non-emergency law enforcement driving. State statutory provisions that govern the motoring public generally regulate non-emergency driving. 2. Agency Policy Requirements - Non-Emergency Driving. Must conform to the requirements of agency policy in order to enjoy protection from civil liability. Failure to comply with agency policy on non-emergency driving may be considered as evidence of the officer's negligence at trial. B. State Statute Requirements - Emergency Response Driving 1. Oklahoma has enacted statutes, which govern the use of law enforcement vehicles in emergency situations. ( I did not write these down...) The student will identify the factors that are involved with and impact the initiation and termination of a Law Enforcement Vehicle Pursuit. - "The safety of an officer and the general public are paramount to the total pursuit situation. Factors that assist in decision-making: No statutory requirements to start/stop pursuit, instead based on Agency Policy, violations, weather, traffic, speeds involved, driving skills, mental/emotional state, danger posed (suspect/LEO driving), equipment status, vehicle capability, alternative methods of apprehension, felony vs. misdemeanor, etc. When pursuit becomes hazardous, it should be terminated. The student will identify the human factors that contribute to law enforcement driving collisions. - The stress endured during pursuit can greatly affect an officer's risk-taking decisions. Attitudes and emotions become significant factors. Prejudice and bias are specific types of attitudes usually based on emotional factors: Psychological Factors: our emotions, high risk attitudes, overconfidence in driving capabilities.
