(10) 7-8 Portfolio assessment 1 – For this assessment we are asking you to collaborate on developing a multilingual glossary for legal philosophy! All students who complete this portfolio assessment will get 5 marks – and our heartfelt thanks... Below you will see a list of key concepts in legal philosophy. For the assessment, choose five concepts and, for each, provide either a synonym 9 or a definition in your home language/other language. Please state what that language is. If your home language is English you can use any other language you might know OR provide an alternative term/definition for the concept. Then please delete the remaining concepts. Here are the concepts: Portfolio assessment 2 – For this assessment, we want you to compare African Legal Philosophy (ALP) with Critical Race Theory (CRT). Which one do you prefer and why. 10 Portfolio assessment 3 – The political term "right" and "left" is used in many countries. For example, in the USA, the Democratic party is seen as "left" while the Republicans as seen as "right". In the UK, on the other hand, the Conservative party is seen as more "right" and the Labour party as "left". But what does it mean in South Africa? For this assessment, you need to do some research and establish a credible definition of "left" and "right" in SA legal philosophy. For this purpose, you need to find a source that would be acceptable in a court of law – therefore case law, legislation, journal articles or the like. Quote the source you found briefly and then explain whether this fits into any of the philosophies you have studied. 11-12 Portfolio assessment 4 – Attached to this is the case of De Beer and Others v Minister of Cooperative Governance and Traditional Affairs 2020 (11) BCLR 1349 (GP). Read through the case and then indicate which theory of interpretation was used in this case. You need not summarise the whole case or deal with every aspect of it. Just indicate which theory you think was used and substantiate that statement with references to the case. Max word count is 300. 13
