As part of this report I have been exploring and investigating the legal and ethical issues in relation
to the use of business information and how does it affect O2
There are a few legal acts that affect the company in many ways and affect customers in positive as
well as negative ways.
Data protection is the act created in 1998 to protect customers from fraud and unfair use of their
personal details such as debit card, email account, internet account such as Facebook, Instagram,
Google and so on, proving them legal rights. It was also created to control the way information is
handled.
Data protection act affects O2 by making them keep the customers information saved and stored in
a safe place, where other persons cannot look though it and get information from there, for example
if a person uses their debit card details to get a service or product O2 should provide, privacy and
security ways to protect customer’s information such as their bank account balance and credentials
and personal details, to avoid fraud or bad use of their information by other persons or companies.
Freedom of information is the act created in 2000 to provide public right access information held by
public authorities which includes NHS, police and government, this act gives a statutory right for
access to information in relation to bodies that exercise functions of a public nature. There are three
different types of bodies that are covered by the act, public authorities, publicly owned companies
and designated bodies performing public functions.
O2 is affected positively by this act because they are allow to get information from the public
authorities when they need to find out about a special information, for example if a person would
like to get a job in the company, O2 can get information about the person by the authorities such as
police information for example if the person has or has had a criminal record or if the person has
been in jail and what other crimes the person has committed so it helps the company to know what
kind of persons they are hiring. Also they could be affected negatively by this act because other
people can get information that could affect the company in their reputation or their financial
status.
Computer misuse act 1990 is a law that was enacted because of the hack of the Duke of Edinburgh
mailbox by Robert Schifrin and Stephen Gold, it legislates certain activities of computing use, such as
hacking the other people’s or organisations’ systems, bad using of software such as the creation of
viruses or helping a person to get access to other people’s protected information, this act makes it
an abuse to access into any computer or information that you don’t have authorised right to use or
get. This act split up into 3 sections and makes illegal, unauthorised access to computer material or
systems with intent to commit other crime or office and unauthorised modification of computer
material.
This act protects O2 from hacker attacks that try to get information of the company such as
customer’s information and use it with malicious intent, this act also protects the company from
viruses that try to affect the company operation, and this act is also related with Data protection act
because O2 data should be in their intranet network, so O2 should have the security of having an act
that protects the confidential information O2 has stored.
