General Duty Clause - -Each employer shall furnish to each of his employees
employment and a place of employment which are free from recognized
hazards that are causing or are likely to cause death or serious physical
harm to his employees.
Each employer shall comply with occupational safety and health standards
promulgated under this act.

than 4 per 100 in 2010

-OSHA inspection Priority - -1st: imminent Danger: reasonable certainty an
immediate danger exists
2nd: fatality and catastrophe: Reported to OSHA: inspection ASAP (1 or more
workers inpatient hospitalization, work-related amputation, loss of an eye,
treatment in an ER is not reportable
3rd: complaints/Referals: worker or workers rep. can file a complaint about
safety or health hazard
4th: Personal Inspection

-Citations and Penalties - -Willful violation : fine must be issued upto
$132,598 max but not below $9472 min
Serious: fine must be issued upto $13,260 max
Other than serious: may be issued upto $13,260 max
Rereated: fine may be issued upto $132,598 max

-Authorized Person - -a person approved or assigned by employer to a
specific type of duty or duties or to be at a specific location or location(s) at
the jobsite.

-Competant Person - -One who is capable of identifying existing and
predictable hazards in the surrpundings or working conditions which are

, unsanitarym hazardous, or dangerous to employees, and who has
authorization to take prompt corrective measures to eliminate them

-Qualified person - -A person who, by possession of a recognized degree,
certificate, or professional standing, or by extensive knowledge, training, and
experience, has successfully demonstrated his ability to solve or prevent
problems relating to the subject matter, the work, or the project.

-Approved - -Means sanction, endorsedm accreditedm certifiedm or
accepted as satisfactory by a duly constituted and nationally recognized
authority or agency

-Shall - -means mandatory

-shoul - -means recommended

-Accident prevention responsibilities - -such programs shall provide for
frequent and regular inspections of the job sites, materials, and equipment
to be made by competent persons designated by the epmloyers

-OSHA Form 300 - -Log of work-related injuries and illnesses

-OSHA Form 301 - -injury and illness incident report
complete this form within 7 calander days of learning recordable work-
related injury/illness

-OSHA form 300a - -Summary of work-related injuries and illnesses
must post between February 1st through April 30th at the end of each year
NOT THE OSHA FORM 300

-Keep the forms on file - -file and update for 5 years
do not send copies to OSHA unless asked to do so

-Electronic Submission - -Beginning in 2019 and every year thereafter all
forms (300,300a, and 301) must be submitted by March 2nd

-time limits to report affter being imformed of the incident - -Fatalities: 8
hours
inpatient hospitilazation of 1 or more employees: with 24 hours
Amputation : within 24 hours
loss of an eye : within 24 hours

-OSHA's definition of an injury or illness - -an abnormal condition or disorder
not an exposure, unless it results in signs or symptoms
