LAW AND SOCIETY.

Questions and answers.
1. Explain the following terms as used in law;
An ordinance of reason

Thomas Aquinas defines law as an ordinance of reason, because it must be reasonable and based on
reason and not merely in the will of the legislator.

Promulgation

It is the act of publicly announcing a new law.

Common good

It is time our elected officials stood up for the common good

One in charge of the society
It is an individual who takes full responsibility to a society.

2. Discuss the relation between law and morality.
 Law is a body of rules and regulations that all people are mandatorily obligated to
adhere to while morals refer to general principles or standards of behavior that define
human conduct within society but are not compulsory to be followed.
 Law governs a man's well- being when he is a member of a particular society while
morals govern a man's manners even when he is alone.
 Laws consider a man's outward manners, while morals consider factors such as inner
resolve and willpower direction.
 Law treats all people in the same manner and doesn't change from person to person
but morality is a subjective concept.
 Law is related to morality in the setting forth of those virtues that are related to the
common good.
3. Explain why it is not legally allowable to defend oneself by invoking ignorance of the law.
This is because it would be impossible to have knowledge of the law, if certain acts were to be
said as a crime retroactively.
Ignorance of the law is no defense, is a widely known pre-consumption of law. This explains
societal backdrops against which it has. The aim is to prove that failure to present the law in a
simplified and digestible form harms the rule of the law.
4. What are the differences of law and morality
 Law is concerned with a person’s individual liberty while morality is concerned with
collective conceptions of what is good and evil.
 Law governs the trait of man when he is a member of a particular society while morality
governs man’s trait even when he is alone.
 Law consists of man’s outside trait while morals consider factors such as will power
direction.
 Law is imposed by external coercion while morality appeal to an individual free will.
