Article 1. Administration - ANSWER-Chapter may be cited as the Physical Therapy Practice Act What is the highest priority of the PTBC in exercising its licensing, regulatory, and disciplinary functions? 2602.1 - ANSWER-Protection of the public Who composes the members of the PTBC? 2603 - ANSWER-One PT involved in PT education (the only one that can be full-time faculty), 3 licensed PTs that have been practicing PT for 5 years, 3 public members who are not licensed by the PTBC or any other Medical Board of CA What is the term of the board members? When does this term expire? 2604 - ANSWER-Term is 4 years, expires on June 1st each year Who appoints the board members? 2604 - ANSWER-The Governor appoints one public member and the 4 PTs. The Senate Rules Committee and the Speaker of the Assembly both appoint 1 public member each How long can a member serve for the board? 2604 - ANSWER-No more than 2 consecutive terms Who is president of the board? 2604 - ANSWER-The members elect one of the members to act as president. This occurs annually Who can remove members of the board, and under what circumstances? 2604 - ANSWER-The appointing power has the ability to remove members for neglect of duties required by law OR for unprofessional/dishonorable conduct What are the mandatory qualifications for the public members of the board? 2604.5 - ANSWER-Shall be a citizen of CA, shall NOT be an officer/faculty member engaged in PT education, shall NOT be licensed by the Medical Board of CA What is the compensation for board members? 2606 Section 103 - ANSWER-Per diem $100 for each day spent in the discharge of official duties, reimbursed for traveling and other expenses incurred from the performance of official duties. These are subject to the availability of money. The member cannot receive board money for a day on which they were compensated for their regular employment. May the board have employees? 2607 - ANSWER-The board may employ clerical assistants and employees deemed necessary to carry out its powers and duties. They shall be considered public employees Who is the "Executive Officer?" 2607.5 - ANSWER-A person exempt from civil service that exercises the powers and performs the duties delegated by the board. They are appointed by the board. What does the Inspections/Report section state? 2608.5 - ANSWER-Each board member or licensed PT appointed by the board may inspect or require reports from any place providing PT services including their records with respect to PT services. When and where MUST the board hold meetings? 2611 - ANSWER-At least once a year, meetings shall be held in Sacramento, LA, and SF. Additional meetings may be held as designated by the board until business is concluded. How must the board give notice of meetings? 2612 - ANSWER-Notice will be given in accordance with the Bagley-Keene Open Meeting Act Who is the commissioner on examination? 2613 - ANSWER-A board appointed, qualified person to give the whole/portion of any examination. They do not need to be a member of the board, but they are subject to the same rules/regulations and entitled to the same fee as if they were a board member. What type of hearings may the board conduct, and what can they do upon conclusion of the hearing? 2614 - ANSWER-The board shall hear matters including but not limited to any contested case or any petition for reinstatement, restoration, or modification of probation; conducted in accordance with Chapter 5...At the conclusion, the board shall deny an application for, suspend or revoke, or impose probation conditions upon, a license or approval What kind of regulations may the board adopt? 2615 - ANSWER-The board may adopt regulations (from time to time) that may be necessary to enforce the PT Practice Act. According to Article 2 General Provisions, what does Physical Therapy mean? 2620 - ANSWER-"The art and science of physical or corrective rehabilitation or of physical or corrective treatment of any bodily or mental condition of any person by the use of the physical, chemical, and other properties of heat, light, water, electricity, sound, massage, and active, passive, and resistive exercise, and shall include PT evaluation, treatment planning, instruction and consultative services." What does the practice of PT include? 2620 - ANSWER-The practice of PT includes the promotion and maintenance of physical fitness to enhance the bodily movement related health and wellness of individuals through the use of physical therapy interventions. What is not authorized under the term physical therapy? 2620 - ANSWER-The use of roentgen rays and radioactive materials for diagnostic or therapeutic purposes, the use of electricity for surgical purposes, and the diagnosis of disease. May PTs use topical medications as part of their practice? 2620.3 - ANSWER-A licensed PT may apply topical medications as part of their practice if they comply with regulations and the Administrative Procedure Act When is a PT allowed to perform tissue penetration? 2620.5 - ANSWER-A PT may perform tissue penetration when specified authorization is made by a physician and surgeon, and if it is for the purpose of evaluating neuromuscular performance as part of PT practice. The PT must be certified by the board to perform the procedure, and they cannot make diagnostic or prognostic interpretations of the data obtained. What are the rules and regulations regarding patient records in Section 2620.7 of the PT Practice Act? - ANSWER-A PT shall document their eval, goals, treatment plan, and summary of treatment in the pt record, as well as care provided. The pt record should be signed legibly. How long should pt records be maintained? 2620.7 - ANSWER-Pt records shall be maintained for no less than 7 years. In the case of an unemancipated minor, pt records must be kept for at least 1 year after they turn 18yo and no less than 7 years in total. What are the limitations of the PT Practice Act? 2621 - ANSWER-It does NOT authorize a PT to practice medicine, surgery, or any other form of healing except those authorized in Section 2620. Which terms mean a person who is licensed to practice PT? 2622 - ANSWER-Physical therapist and Physical Therapist Technician What is the difference between physical therapy and physiotherapy? 2622 - ANSWER-They are the same/interchangeable in the PT Practice Act In CA, can a person practice PT for compensation or represent themselves as at PT if they do not have a valid, current license? 2630 - ANSWER-NO How many aides may one licensed PT utilize in pt-related tasks? 2630 - ANSWER-One; The aide shall be under the direction and immediate supervision of the PT at all times What is a "pt-related task?" 2630 - ANSWER-A PT service rendered directly to the pt by an aide, and excluding non-patient-related tasks. What is a "non-pt-related task?" 2630 - ANSWER-A task related to observation of the pt, transport of the pt, physical support only during gait or transfer training, housekeeping, clerical duties, etc.
