Introduction
In this report I shall be describing the legal, ethical and operational issues within a
business, in 3 different areas, and how they are used within the organization.

In many organizations there are laws that are set to protect the organization from
any unwanted acts. For example there is the Freedom Of information Act
(2000). This act helps individuals, and organizations to have the right to request
for information, from anywhere in the world that is held by the public authorities,
such as schools, hospitals and the police. This act also ensures that the public
authorities must reply within 20 working days to inform you on whether you can
have the information or not. However, when requesting the information you must
ensure you do this formally. For example, you can email them or send them a
letter with the use of formal language, with the consideration that you don’t have
to tell them why you want the information and they don’t have the right to ask,
but if they believe the information will be used for wrongful acts, and then they
have the right to refuse you. But organizations cannot ignore the request, if the
police or the national security system makes it. This is because the information
may come in handy to them, or it may be a threat.
Advantages and Disadvantage of Freedom of Information Act
(2000)
Organizations such as NewVic have information of students and teachers. It is
their duty to keep the information safe. However if information is requested by
other organizations such as universities, or work experience places, then NewVic
have the right to give out their students information, but they have to ensure that
the request is made, as they don’t want to be sending information to the wrong
people. Universities, and work experience can request information from the
college, as it will allow them to get information on the students, such as reference
of the students and the grades. This will ensure both the organization that they
have the right students for the given place/work. Therefore this is known as an
advantage.

Another advantage that falls under the Freedom of information act (2000) is that
students have the right request for their personal information. Students may
request for their personal information, when they have lost their first copy. The
information maybe to do with a contract on their behavior or their attendance,
their target grades or grades, this information can also be requested by the
pupil’s parents. Furthermore, this allows students to change any information that
is incorrect, which will allow NewVic to be kept updated.

On the other hand NewVic have the right to decline the request, if another pupil’s
parent makes it, or if it is made by someone and they aren’t certain if the person
has any relation with students. This is because of the Data Protection Act; this
can be seen as a disadvantage, as the pupil’s parents may get frustrated due to
this.

Another disadvantage for Freedom of Information Act is that individuals have to
formally request for their personal information, which may be seen as a time
waste. For example NewVIc may have to receive a formal request by a pupil’s
parent to be able to see their child’s report. This is because this falls under the
Data Protection Act.

, Data protection Act (1998)
This act is designed to protect personal information, which is stored in an
organization, on their computers or filing cabinets. This was created so individuals
were protected from the misuse of information. The information that falls under
this law is personal data, which can be a person’s name, number, address, or date
of birth.

This act also provides individuals with certain rights. For example if a person
wants to update their information, then they have the right to this, or be supplied
with data that is held about the individual. However there are some exemptions,
within this law. As, for example the police can have access to this information, or
the taxman to see if you have paid the right amount or not.

Advantages and Disadvantages of Data Protection Act (1998)
There are many advantages within this law, in an organization. For example this
act ensures that all information of students within NewVic is kept safely, and
handled in the correct manner, where no one else can have access to the
information; accept the teachers and students themselves. This ensures the
students within NewVic to feel safe and be able to trust NewVic with their personal
information. This law also ensures that NewVic ensure their pupils, if any third
party request for their pupils information. Therefore this is seen as an advantage,
as it allows the students to have relationship with NewVic, allowing them to feel
more comfortable, to share their information.

However, a disadvantage of Data protection Act might be that it is expensive to
store data the correct way. This will be a disadvantage within NewVic as they
might have to spend more than expected, as then they will be ensured that they
have the right facilities to store their data on. But this will mean NewVic may have
to reconsider on what facilities that they should provide for their students,
because of the expensiveness of storing data. Therefore this is seen to be as a
disadvantage.



Computer Misuse Act (1990)
This Act was created to protect computer users from doing wrongful acts, or
stealing information. The Act has 3 levels of offences, which are unauthorized
modification, such as hacking into a system, and stealing the information, or
changing the information around. Another offence is unauthorized access to the
information as well having unauthorized access to the Internet, where you do
wrongful acts.

Advantages and Disadvantages of Misuse Act (1990)
The computer misuses act is seen be an advantage to NewVic. This is because it
allows NewVic to ensure their files that contain information are secure and safe,
and if people who have no access to this information, access the information,
have to face the consequences. This means that if NewVics information has been
hacked into, then they have the right to report this and the person involved will be
caught. This act also ensures that teachers don’t misuse student’s information,
and other students don’t misuse other student’s information. For example in
NewVic students must wear their lanyards, they are not allowed to give it any
other students. As if they do then the teachers may end up getting confused,
thus to avoid this students must wear their own lanyards, if they don’t then there
are consequences.

This disadvantage of computer misuse act within NewVic might be that, it may
cause NewVic to lose money when it comes to lawsuits. For example is someone
hacked into his or her system then they would have to take the person to court.
