Legislations
Mental Health Act 1983


The Mental Health Act 1983 encourages anti discriminatory practice as it makes
certain that those who suffer with mental health problems still receive a high level of
care despite their condition. For instance within a mental health hospital the mental
health act helps to promote anti discriminatory practice by ensuring that all staff
members are fully trained on how to keep patients safe.


Disability Discrimination Act 2005
The Disability Discrimination Act 2005 is a legislation which makes certain that those
who have disabilties still have rights and do not suffer from any form of discrimation.
This legislation aims to overcome discrimination by preventing barriers that people
who are disabled or have health conditions may have.For example it promotes anti
discriminatory practice by enabling accessibility for people with disabilities for
example installing ramps so that wheelchair users are able to get into and out of
hospitals,clinics etc. This allows disabled people to get equal treatment.

European Convention on Human Rights and Fundamental Freedoms 1950

The European Convention on Human rights and fundamental freedoms 1950
protects the human rights of people in Europe. This promotes anti discriminatory
practice as it makes it illegal to discriminate people because of their
race,religion,gender etc.

The Convention on the Rights of the Child 1989


The Convention on the Rights of the Child 1989 ensures that those under the age of
18 are protected from discrimination,neglect and abuse. It covers the
civil,political,economic,social and cultural rights of every child. This convention
promotes anti discriminatory practice because it ensures children are protected and
they are entitled to their rights. It also allows children to be protected from
discrimination by allowing them follow their religion in school.For example allowing
them to wear a hijab or turban in school environments and workplaces. It also
promotes anti discriminatory practice by ensuring that children have somewhere safe
to live. For instance not near any war zones and hazardous areas which would
cause ill health.


Regulations

Nursing and residential care home regulation 1984

This regulation applies to nursing and residential care homes. Before these settings
are allowed to start operating they must ensure that they have a license from their
local council. This regulation promotes anti discriminatory practice as it makes
certain that service users are receiving a high level of care despite their
race,sexuality,class etc. In terms of receding a high level of care this means bathing
service users on a regular basis to prevent their skin from breaking down and getting
infections. If complaints are made by either staff within the setting or visitors they
face the council prosecuting them which could further lead to the organisation being
forced to close down.

Employment Equality (Age) Regulation

The Employment Equality (Age) Regulation 2006 protects employees from
discrimination because of their age. This promotes anti discriminatory practice
because people of all ages whether young or old will be able to get a job in a
particular sector despite their age as long as they are qualified for the job and have
the necessary skills.
